Arrested for California DUI

California has established laws that pertain to driving under the influence (DUI) of alcohol (BAC = blood alcohol content), medication, or illegal drugs. According to these California laws, is it illegal to operate a motor vehicle with any of the following blood alcohol content percentages:

  • 0.08% or higher―21 years of age, operating a regular passenger vehicle
  • 0.04% or higher―21 years of age, operating a commercial vehicle
  • 0.01% or higher―younger than 21 years of age, operating any type of vehicle

Additionally, the state’s laws prohibit the operation of a motor vehicle in California if there are:

Excessive amounts of prescription drugs
Drugs with alcohol in them (i.e., cough syrup)
Over-the-counter medication
DUI convictions on your California record for 10 years.
